1. Acceptance of Terms

By accessing or using the Platform, you agree to these Terms and to the Privacy Policy, which is an integral part of this document. If you do not agree with any provision, do not use the Platform. Continued use after updates means you accept the current version.

2. Definitions

• "User" / "you": the individual or entity that accesses or uses the Platform.
• "Account": an individual, non-transferable registration granting access to features.
• "Content": text, signals, analysis, courses, charts, data and materials made available on the Platform.
• "Signals": indications of possible entry, stop and target points generated by algorithms and/or AI, solely educational and informational.
• "Credits": consumable units used to generate premium AI analyses.
• "Broker": a third-party institution (e.g., via MetaTrader 4/5) where execution and custody of funds occur.

3. Nature of the service

TraderClub.ai is a community, education and technology platform for traders. We are NOT a financial institution, broker-dealer, asset manager or licensed investment advisor. We do not collect, manage, custody or intermediate third-party funds. Content, Signals and analysis are educational and informational and do NOT constitute investment advice, financial advisory, an offer, a promise of returns or a solicitation to buy or sell any asset.

4. Eligibility

To use the Platform you must be at least 18 years old and have full legal capacity. If using on behalf of an entity, you represent that you are authorized to bind it. You are responsible for verifying that using the Platform and trading the markets are permitted in your jurisdiction; access is prohibited where the law forbids it.

5. Registration, account and security

You agree to provide true, current and complete information and to keep it updated. The Account is personal and non-transferable. You are solely responsible for keeping your credentials confidential and for all activity under your Account. Notify us immediately of any unauthorized use. We may refuse, suspend or terminate accounts that violate these Terms.

6. Plans, credits and payment

The Platform offers a free plan and paid plans (monthly or annual) and one-off credit packs. Prices, features and limits in force are those displayed at the time of purchase. Subscriptions renew automatically for the contracted period until cancelled. Applicable taxes may apply. If a payment fails, access to paid features may be suspended.

7. Cancellation and refunds

You may cancel renewal at any time; access remains active until the end of the period already paid. Where consumer law grants a withdrawal right, distance purchases may be undone within the applicable period. Consumed credits and periods already used may be non-refundable, except where required by law.

8. Market risk

Trading financial markets — Forex, cryptocurrencies, stocks, indices, commodities and derivatives — involves HIGH RISK and may result in partial or TOTAL loss of capital and, with leveraged products, may exceed the amount initially deposited. Markets are volatile and unpredictable. Past results, simulations and backtests do NOT guarantee future results. Trade only with money you can afford to lose. You are solely responsible for your decisions and trades.

9. Signals and artificial intelligence

Signals and analysis are generated by algorithmic and AI models from market data, are probabilistic and educational, and carry no guarantee of accuracy, availability, timeliness or outcome. The AI may be wrong, delayed or unavailable, and its performance varies with market conditions. Any decision to trade based on Signals is solely yours.

10. Automated execution and broker integration

Execution and copy-trading features operate through YOUR broker account (e.g., via MetaTrader 4/5, or through a PERSONAL API token that you yourself generate at the partner broker — such as B2Trader/FXBiTI). TraderClub.ai only transmits instructions you authorized; we are not the broker, do not custody funds and do not guarantee execution, price, liquidity or absence of slippage. Your credentials and tokens are stored encrypted and used only for the authorized integration. Automated (auto-copy) execution of REAL-money orders is enabled ONLY upon your EXPLICIT CONSENT, recorded with date, version and origin for audit purposes — without that consent, no order is executed automatically. You may revoke the token at the broker or turn off auto-copy here at any time, which immediately stops new executions. You are responsible for configuring risk limits and for all orders executed on your account, including in automatic mode.

11. User conduct

When using the Platform, you agree not to:

• violate laws, regulations or third-party rights;
• post unlawful, defamatory, fraudulent, misleading, offensive content or unauthorized investment advice;
• manipulate, falsify or mislead others about results or performance;
• attempt to access restricted areas, bypass security, reverse engineer or overload the infrastructure;
• share the Account, resell or commercially exploit the Platform without authorization;
• use the Platform for money laundering, illicit financing or any fraudulent activity.

12. User content

You retain ownership of the content you post (posts, comments, media). By posting it, you grant TraderClub.ai a worldwide, non-exclusive, royalty-free license to host, display and distribute that content on the Platform in order to operate it. You are responsible for what you post and authorize us to moderate, remove or restrict content that violates these Terms.

13. Intellectual property

The Platform, its brand, logos, software, design, texts, courses and other materials are owned by TraderClub.ai or its licensors and protected by law. We grant you a limited, personal, revocable and non-transferable license to use them solely for the purposes set out in these Terms. Any unauthorized reproduction, distribution or exploitation is prohibited.

14. Privacy and data protection

We process your personal data in accordance with applicable data-protection law (including Brazil's LGPD) and our Privacy Policy. You have the right to access, correct, export and delete your data, among others, and may exercise them in your Account settings or via our contact channels.

15. Disclaimer of warranties

The Platform is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted availability, error-free operation or financial results. We do not guarantee profit, performance or the accuracy of third-party data.

16. Limitation of liability

To the maximum extent permitted by law, TraderClub.ai, its partners, officers and affiliates are not liable for direct, indirect or incidental damages, lost profits, loss of trading capital or damages arising from the use or inability to use the Platform, investment decisions, broker/third-party failures or downtime. Nothing here excludes liabilities that cannot be limited by law.

17. Indemnification

You agree to indemnify and hold TraderClub.ai harmless from any claims, losses, liabilities and expenses (including legal fees) arising from your use of the Platform, your breach of these Terms or third-party rights.

18. Suspension and termination

We may suspend or terminate your access, with or without notice, for breach of these Terms, legal requirement or risk to the Platform or others. You may close your Account at any time in the settings. Termination does not affect obligations already incurred.

19. Changes to the Terms

We may update these Terms at any time. Material changes will be communicated through official channels and/or on the Platform, indicating the effective date. Use after the effective date means acceptance of the new version.

20. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the consumer's domicile are elected to settle disputes, without prejudice to other means provided by law.

21. General provisions

If any provision is held invalid, the remainder stays in force. Tolerance of a breach is not a waiver. You may not assign your rights without our consent; we may assign ours in the context of corporate reorganization. These Terms, together with the Privacy Policy, constitute the entire agreement between the parties.
